Three people also died during Boudicca´s latest cruise, but the company said the deaths were not linked to Norovirus.&lt;br /&gt;&lt;br /&gt;Derek and Marina Eaton contracted the virus during the last December cruise on what was supposed to be the holiday of a lifetime. The couple had booked the most expensive suite available on the Boudicca at £10,155 for a 14 day trip to Madeira and the Canaries, and Mr Eaton described it as a ´cruise from hell.´&lt;br /&gt;&lt;br /&gt;On the first of three cruises in December, the Boudicca departed from Portsmouth on December 6th, and 180 out of 800 passengers were hit by gastroenteritis. When the 28,000 ton ship returned to Portsmouth on December 18th, it was ´deep-cleaned´ according to the owners and later that day, departed on a four-day mini-cruise to Amsterdam. Out of 827 passengers on this cruise, at least 50 were taken ill with Norovirus.&lt;br /&gt;&lt;br /&gt;The Boudicca was then deep-cleaned again before the ill-fated cruise which left Portsmouth for Madeira on the 22nd December, and this time, 289 out of 795 passengers were diagnosed with the stomach bug. The ship returned to Portsmouth a day early.&lt;br /&gt;&lt;br /&gt;Fred Olsen blamed passengers for bringing the virus aboard, although the latest outbreak was the seventh time in the past year that one of the firm´s vessels has been hit by illness. Another outbreak on the Boudicca happened in October.&lt;br /&gt;Mr Eaton, 75, a company owner, from Woburn Sands in Bedfordshire, said he and his wife had been looking forward to spending New Year's Eve in Madeira to see the island's fireworks display, which is said to be the largest in the world.&lt;br /&gt;&lt;br /&gt;But after falling ill, they spent the night confined to their cabin and missed the display. They had to spend a total of four days in their cabin and missed three of the six islands on the cruise. Who can actually make a claim?&lt;/strong&gt;&lt;br /&gt;&lt;br /&gt;You can claim on your own behalf if you are the injured person (the claimant). If the person with a case for compensation is under the age of 18, the court will appoint a ´litigation friend´ who is normally a parent or close relative.  If the injured person cannot make decisions for him/herself, or is in any way incapacitated, the court may also appoint a ´litigation friend´, who typically will be a close relative. If a claim is made on the behalf of someone who has died, their dependants have the right to make a claim on their behalf.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;3. What is the time limit for making a claim?&lt;/strong&gt;&lt;br /&gt;&lt;br /&gt;In most cases the time limit is 3 years from the date of the accident, although you are always recommended to contact a personal injury solicitor as soon as possible. If an injured person proves another person acted negligently, which resulted in an injury, the injured party can claim financial compensation for harm done. For example, an employer owes a duty of care to ensure his employees are provided with a safe work environment. What is partial admission on the part of the defendant?&lt;/strong&gt;&lt;br /&gt;&lt;br /&gt;Partial admission is when the defendant admits he is partly guilty for an accident or injury, but also claims the incident was not all his fault. He may allege that the Claimant was partly to blame for injuries sustained or that another party was at fault. If the defendant is only proved to be partly at fault, a Judge could reduce the amount of compensation to be paid to the claimant. For example, if a claimant is injured after his car has been hit by another vehicle, and his injuries are made worse by the fact he is not wearing a seatbelt, the Judge could reduce the compensation award by 25%.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;12. This can be done by the court or by us, and the documents have to be served within 4 months of the date of issue.&lt;br /&gt;&lt;br /&gt;The defendant then has 14 days to acknowledge receipt of the proceedings, which can be done easily by posting the reply slip on the back of the document. If the claim is for personal injury, other documents which must be served within 4 months include:&lt;br /&gt;&lt;br /&gt;• Particulars of the claim, which is a formal statement explaining the actual circumstances of the accident, the fault alleged by the claimant and the injury suffered, plus medical evidence and details of financial loss.&lt;br /&gt;&lt;br /&gt;• A medical report, written by a qualified medical practitioner, that states the circumstances of the accident, the injuries to the claimant, and the affect they have had on him.&lt;br /&gt;&lt;br /&gt;• A schedule of financial loss, which sets out any special damages. &lt;br /&gt;&lt;br /&gt;&lt;strong&gt;17. What is the Defence?&lt;/strong&gt;&lt;br /&gt;&lt;br /&gt;The Defence is the reply from the defendant to the particulars of the claim. He will either admit liability, partially admit liability or deny liability completely. The Defence is due just 14 days after acknowledgement of service is filed, but if all parties are in agreement, an extension up to 1 month can be arranged. What First Choice don´t tell customers when they book is that the company admitted liability for claims against the hotel in 2005, 2006 and 2007.&lt;br /&gt;&lt;br /&gt;One rep blamed the ´oily food´ for holidaymakers becoming ill, but went on to say ´there´s no sort of disease or bug or anything.´ &lt;br /&gt;&lt;br /&gt;When Watchdog sent undercover researchers to check out the Holiday Village, Sarigerme, Turkey, the restaurant looked spotless and there were cleaners everywhere, but they also met more holidaymakers who had become seriously ill with sickness and diarrhoea.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;Carole Monteverd was part of a group of 21 from Manchester who stayed at the Holiday Village, Sarigerme, Turkey. Thirteen of the group became ill, and four more developed symptoms on their return to the UK.&lt;br /&gt;&lt;br /&gt;Eleven year old Victoria Shaw developed Salmonella, and her father Mark caught Campylobacter, which is an intestinal disease caused by undercooked meat or cross-contamination of food. Mark said he was so ill he couldn´t climb the stairs and on one day he went to the toilet 37 times.&lt;br /&gt;&lt;br /&gt;Although First Choice claims to have sent independent experts to the resort three times this year, people are still falling ill. Watchdog heard many cases of people falling ill with vomiting and diarrhoea just a few days into their stay at the Holiday Village.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;Some holidaymakers had to seek urgent medical treatment in the resort, and some even had to be hospitalised.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;First Choice are adamant that every precaution is taken before sending people to the Holiday Village, Sarigerme, and a spokesman said:&lt;br /&gt;&lt;br /&gt;“At First Choice, the health and well being of our customers is our primary focus, and we would like to apologise to anyone who has experienced sickness whilst staying at the Holiday Village, Turkey.&lt;br /&gt;&lt;br /&gt;“The Holiday Village in Turkey is and continues to be very popular, with the substantial majority of customers rating the property highly in customer satisfaction surveys. In fact, over 80% of our guests would recommend the resort to a friend. However, we will continue to do everything we can to ensure that all of our customers have a safe and enjoyable holiday.
