Holiday sickness at Riu Bachata in the Dominican Republic

Complaints are being received from holidaymakers who have been struck down with sickness at the luxury Riu Bachata hotel in the Dominican Republic.

One couple were staying at Riu Bachata to get married, with a group of friends and family in March 2010 and fell ill with vomiting and diarrhoea just three days into the holiday. The groom-to-be spent his wedding day in hospital, and said that a lot of other guests were ill on the complex, including other members of the wedding party.

He went on to say: "My brother saw a chef come out of a toilet cubicle in his full chef whites. When I came out of hospital I was scared to eat the food which all tasted the same anyway. There is no way it should be classed as 5 star and wouldn't recommend it to my worst enemy."
The bridegroom spent another two days in hospital and his bride and many other members of the party also fell ill at the Riu Bachata with severe diarrhoea and sickness.

The Riu Resort in Puerto Plata, Dominican Republic, consists of Club Hotel Riu Merengue, Club Hotel Riu Bachata and Club Hotel Riu Mambo, and accommodation is provided on an all-inclusive basis.

Another couple at the hotel were horrified when their 18-month daughter was taken ill and they were advised she "could die from dehydration" after being admitted to hospital.

More sickness complaints on board the Boudicca Cruise ship

Passengers on The Fred Olsen ship, Boudicca saw three outbreaks of Norovirus during 2009 on three separate cruises. Holiday sickness on board the Boudicca took place on the cruise to Madeira on 22nd December, 2009. Norovirus was also reported on the Boudicca mini-cruise to Amsterdam on 18th December, 2009.

The Boudicca cruise which left Portsmouth on December 6th, 2009 saw 180 passengers taken ill after the Norovirus outbreak, and the ship had to return to Portsmouth a day early on the 18th December. The ship was then reportedly deep-cleaned and it left the port for a mini-cruise to Amsterdam later on the same day. Norovirus broke out once again and 50 passengers were ill.

The Boudicca was apparently deep cleaned again after the mini-cruise to Amsterdam, and it set sail again for Madeira on the 22nd December, 2009. This cruise saw the worse outbreak of Norovirus on board the Boudicca, when 289 out of 795 passengers were diagnosed with the virus.
Another outbreak of food poisoning on board the Boudicca occurred in October 2009, and although the ship was reported to have been deep cleaned after this, further outbreaks of Norovirus took place on two more subsequent cruises.

The all inclusive hotel in Puerto Santiago, Tenerife, has been the subject of several outbreaks of food poisoning over the past few months, and guests have also complained about cockroaches in the rooms.

One guest found cockroaches crawling around in the bathroom, and when she was moved to another room, there was an infestation of bugs in the living room of the apartment.
She says: “The day after finding the cockroaches, my husband went down with sickness and diarrhoea. He was confined to the room for two days which ruined the rest of the holiday. Other guests were also ill with gastroenteritis, which we could only put down to the food, which was usually served lukewarm. We heard reports that a sickness outbreak had been going on for months at the Tamaimo Tropical, but we were not informed before we arrived.”

Another couple were seriously ill after eating pork at the hotel. One of the affected holidaymakers says: “After both of us eating pork one night we were ill with sickness and diarrhoea shortly after returning to our room. We reported the sickness to the reps and the hotel management who passed it off as being a bug on the island. It was only two days later, when we were well enough to talk to other guests, that we realised many other people had been taken ill on the same night after eating pork.”

A group of holidaymakers who booked an all-inclusive break as part of birthday celebrations, also reported food poisoning and sickness among their party.

One holidaymaker said: “On the second day of the holiday one of our part was ill with diarrhoea and vomiting, and then three more members of the party were struck down with the same illness. We talked to other guests who all reported being ill with the same symptoms, and one woman told us that illness outbreaks were common at the Tamaimo Tropical. The virus is out of control but still the tour operator keeps sending unsuspecting holidaymakers here – it´s a disgrace. If you want your holiday ruined, this is the place to come.”

Boudicca Cruise ship sickness update

After many complaints were made to Fred Olen Cruise Liners, following outbreaks of Norovirus and sickness on board the Boudicca cruise ship, scores of passengers have still not been compensated by the company.

Passengers who were struck down by Norovirus and suffered gastroenteritis on board the Boudicca cruise ship during a cruise to Madeira on 22nd December, 2009 and a mini-cruise to Amsterdam on 18th December, 2009 have still not received satisfactory replies from Fred Olsen Cruise Liners, and some passengers have had no response at all.

Complaints have been made about a possible outbreak of Norovirus and gastroenteritis at the Flamingo Oasis Hotel in Benidorm.

Holidaymakers reported violent vomiting, sickness, stomach cramps and diarrhoea among guests at the Flamingo Oasis during December, 2009 and January, 2010. Four members of one family had to be treated for dehydration and sickness, after eating in the all-inclusive hotel restaurant.

A smell of sewage was said to have been evident throughout the hotel, particularly when bathroom taps were turned on, and the toilet was flushed.

Possible Salmonella outbreak at Club Playa Blanca Lanzarote

Holidaymakers have reported a possible salmonella outbreak at the four-star Club Playa Blanca in Lanzarote, where it is believed that people were taken ill after eating at the hotel between the 6th and 14th January, 2010.

People have been prescribed antibiotics by a local chemist, who said that a number of people staying at the Club Playa Blanca had complained of sickness, vomiting and stomach cramps, after eating at the hotel.

Some holidaymakers also confirmed that others staying at the hotel had been struck down with a similar illness, although they could not confirm it was Salmonella.

Complaints were also made against the Club Playa Blanca in Lanzarote in August and September, 2008.

Norovirus outbreak on the Boudicca Cruise Ship

Three outbreaks of Norovirus and gastroenteritis have struck down passengers on the Boudicca Cruise Ship during winter. Over 500 passengers have been taken ill with the virus during three winter cruises onboard the Boudicca luxury cruise ship, despite owners, Fred Olsen, insisting the ship was safe.

According to Fred Olsen Cruise Lines, the Boudicca was deep-cleaned twice following outbreaks of Norovirus, but the virus continues to return. Three people also died during Boudicca´s latest cruise, but the company said the deaths were not linked to Norovirus.

Derek and Marina Eaton contracted the virus during the last December cruise on what was supposed to be the holiday of a lifetime. The couple had booked the most expensive suite available on the Boudicca at £10,155 for a 14 day trip to Madeira and the Canaries, and Mr Eaton described it as a ´cruise from hell.´

On the first of three cruises in December, the Boudicca departed from Portsmouth on December 6th, and 180 out of 800 passengers were hit by gastroenteritis. When the 28,000 ton ship returned to Portsmouth on December 18th, it was ´deep-cleaned´ according to the owners and later that day, departed on a four-day mini-cruise to Amsterdam. Out of 827 passengers on this cruise, at least 50 were taken ill with Norovirus.

The Boudicca was then deep-cleaned again before the ill-fated cruise which left Portsmouth for Madeira on the 22nd December, and this time, 289 out of 795 passengers were diagnosed with the stomach bug. The ship returned to Portsmouth a day early.

Fred Olsen blamed passengers for bringing the virus aboard, although the latest outbreak was the seventh time in the past year that one of the firm´s vessels has been hit by illness. Another outbreak on the Boudicca happened in October.
Mr Eaton, 75, a company owner, from Woburn Sands in Bedfordshire, said he and his wife had been looking forward to spending New Year's Eve in Madeira to see the island's fireworks display, which is said to be the largest in the world.

But after falling ill, they spent the night confined to their cabin and missed the display. They had to spend a total of four days in their cabin and missed three of the six islands on the cruise. Mr Eaton said: 'The management of the company should have cancelled the cruise once the first set of passengers fell ill.

'I don't believe for one second that they deep-cleaned the ship because there wasn't sufficient time.'

Cryptosporidium is said to have broken out at the Aqua Fantasy Hotel in Kusadasi, which left holiday-makers suffering symptoms including diarrhoea, stomach cramps and sickness. If the injured person cannot make decisions for him/herself, or is in any way incapacitated, the court may also appoint a ´litigation friend´, who typically will be a close relative. If a claim is made on the behalf of someone who has died, their dependants have the right to make a claim on their behalf.

3. What is the time limit for making a claim?

In most cases the time limit is 3 years from the date of the accident, although you are always recommended to contact a personal injury solicitor as soon as possible. If you fail to settle the matter or to issue court proceedings within 3 years, your claim will become statute-barred under the Limitation Act of 1980. 4. Can I still claim if 3 years have gone by?

If there is a particularly good reason for the delay in claiming, the court will allow a claim to be made ´out of time´. It is however completely up to the court, and the safest way to make sure your claim is heard is to make it as soon as you can after the accident.

5. What counts as being an injury?

You can only claim compensation for an injury or illness that was the fault of someone else. An injury is a physical or psychological harm which must be more than minimal, and you must suffer some actual symptoms. Your solicitor will need to get a medical report to confirm the extent of your injury and to inform the court what was the likely cause of the injury and what is the extent of the injury.

6. What actually is fault?

You can only claim compensation if someone was legally at fault for your injury/illness. If that person was negligent or breaks a law or regulation, the injured person can make a claim against them.

7. What constitutes negligence?

Negligence can be defined as behaviour or conduct that is blameworthy, as it falls short of what a reasonable person would do to protect another from risk of harm. If an injured person proves another person acted negligently, which resulted in an injury, the injured party can claim financial compensation for harm done. For example, an employer owes a duty of care to ensure his employees are provided with a safe work environment. If an employer leaves wires and cables strewn across the floor of the workplace, and an employee trips and breaks his leg, the employer would be negligent and liable to pay financial compensation. There is also a statutory duty on employers to keep walkways clear and in good repair, so in this instance, negligence could be proved plus a breach of statutory duty.

8. What does financial compensation mean?

Financial compensation or ´damages´ is money that a claimant is awarded after an accident, injury or illness which was the fault of someone else.

General damages are lump sums, payable to compensate the claimant for pain, suffering and loss of amenity. The amount payable depends on the severity of the injury and the extent of the symptoms. In most cases, the more severe the injury, the higher the award of general damages.
Special damages are past and future financial losses which are directly linked to the injury. Most common special damages are claims for future lost earnings, the cost of replacement of damaged items and the cost of medical treatment and drugs.

9. How can I make a claim?

Firstly, you should know that claims management companies are not qualified to deal with court proceedings, and they cannot represent you in court. 11. What is partial admission on the part of the defendant?

Partial admission is when the defendant admits he is partly guilty for an accident or injury, but also claims the incident was not all his fault. He may allege that the Claimant was partly to blame for injuries sustained or that another party was at fault. If the defendant is only proved to be partly at fault, a Judge could reduce the amount of compensation to be paid to the claimant. For example, if a claimant is injured after his car has been hit by another vehicle, and his injuries are made worse by the fact he is not wearing a seatbelt, the Judge could reduce the compensation award by 25%.

12. What does expert evidence mean?

Claimants in personal injury cases always have to obtain an expert medical opinion, so that they can inform the court about the exact injury caused by the accident, plus the likelihood of any long term effects. When serious injury takes place, more than one expert medical report is normally required by the court.
If treatment or recovery is ongoing, it may take more time for medical evidence to be obtained, or it may not be possible to give a long term prognosis until a longer amount of time has passed. Claimants can often become frustrated when claims are delayed, but medical matters are often out of the hands of the personal injury solicitors.
A non-medical expert could be instructed to advise the judge on specialist areas such as reconstruction after an accident, but the expert´s duty is always to the court and not the claimant.

13. What does an ´offer to settle´ mean?

An ´offer to settle´ is an attempt to come to an agreement without court proceedings. This offer can be made at any stage of the claims process by either party. This agreement can relate to liability or value.

14. What if the case is not settled?

If both parties cannot come to an agreement, or if the 3 year time period is about to end, we would recommend that court proceedings take place.

15. What is an issue of court proceedings?

An issue of court proceedings means lodging the claim form with the correct fee at the court office. The form is then stamped with the court seal and a form will be issued called the ´Notice of issue of Court Proceedings.´ This document, along with the claim form are known as ´Proceedings´, and this is a formal step which starts the legal process and can end up with a court trial before a judge. The claimant, or his representatives, must issue court proceedings within 3 years of the date of the accident.

16. What happens after court proceedings have been issued?

Court proceedings must be served once they have been issued, which means they have to be sent, delivered or handed to the defendant at their home, place of business of registered office. This can be done by the court or by us, and the documents have to be served within 4 months of the date of issue.

The defendant then has 14 days to acknowledge receipt of the proceedings, which can be done easily by posting the reply slip on the back of the document. If the claim is for personal injury, other documents which must be served within 4 months include:

• Particulars of the claim, which is a formal statement explaining the actual circumstances of the accident, the fault alleged by the claimant and the injury suffered, plus medical evidence and details of financial loss.

• A medical report, written by a qualified medical practitioner, that states the circumstances of the accident, the injuries to the claimant, and the affect they have had on him.

• A schedule of financial loss, which sets out any special damages.

17. What is the Defence?

The Defence is the reply from the defendant to the particulars of the claim. He will either admit liability, partially admit liability or deny liability completely. The Defence is due just 14 days after acknowledgement of service is filed, but if all parties are in agreement, an extension up to 1 month can be arranged. If a longer extension time is required, court permission is needed.

18. What happens after the Defence has been received?

The court will invite both parties to submit a timetable to trial, but if they can´t agree, the Judge will impose a timetable which is known as the court ´directions.´ This document will make clear the steps both parties need to take to prepare the case for trial, and will allocate a trial window, within which the date of the trial will fall. The court will attempt to arrange a trial date as soon as possible, and the ´directions´ will include a date for exchange of documents and witness statements, plus other necessary documents so both sides are ready for the trial date.

19. What is included in a list of documents?

A list of documents includes everything the claimant may rely on to support his case in court. This can typically include: witness statements and medical reports showing evidence of injuries.
20. What is Exchange of Witness and Expert Evidence?
Each party, the claimant and the defendant, will send their witness and expert evidence to the other party on a date decided by the court. Both parties can put questions to each other´s expert witnesses to try and find some common ground with the issues being disputed.

21. What happens if the case is still not resolved?

If both parties cannot reach an amicable agreement, there will be a court trial, presided over by a Judge. Salmonella scare at the Holiday Village Turkey

The hotel, on the south-west coast of Turkey is exclusive to First Choice for the UK customers, and with 17 pools and 12 restaurants, the complex is sold to customers as an ideal all-inclusive resort for families. What First Choice don´t tell customers when they book is that the company admitted liability for claims against the hotel in 2005, 2006 and 2007.

One rep blamed the ´oily food´ for holidaymakers becoming ill, but went on to say ´there´s no sort of disease or bug or anything.´

When Watchdog sent undercover researchers to check out the Holiday Village, Sarigerme, Turkey, the restaurant looked spotless and there were cleaners everywhere, but they also met more holidaymakers who had become seriously ill with sickness and diarrhoea.

Carole Monteverd was part of a group of 21 from Manchester who stayed at the Holiday Village, Sarigerme, Turkey. Thirteen of the group became ill, and four more developed symptoms on their return to the UK.

Eleven year old Victoria Shaw developed Salmonella, and her father Mark caught Campylobacter, which is an intestinal disease caused by undercooked meat or cross-contamination of food. Mark said he was so ill he couldn´t climb the stairs and on one day he went to the toilet 37 times.

Although First Choice claims to have sent independent experts to the resort three times this year, people are still falling ill. Watchdog heard many cases of people falling ill with vomiting and diarrhoea just a few days into their stay at the Holiday Village.

Some holidaymakers had to seek urgent medical treatment in the resort, and some even had to be hospitalised.

First Choice are adamant that every precaution is taken before sending people to the Holiday Village, Sarigerme, and a spokesman said:

“At First Choice, the health and well being of our customers is our primary focus, and we would like to apologise to anyone who has experienced sickness whilst staying at the Holiday Village, Turkey.

“The Holiday Village in Turkey is and continues to be very popular, with the substantial majority of customers rating the property highly in customer satisfaction surveys. In fact, over 80% of our guests would recommend the resort to a friend. However, we will continue to do everything we can to ensure that all of our customers have a safe and enjoyable holiday. We also employ our own health and hygiene specialist who is based at the property, and water samples from each swimming pool are tested at least four times a day.”

Symptoms can show up 4 hours to 8 days after ingestion, and include weakness, vertigo, double vision, difficulty in speaking, swallowing and breathing, muscle weakness and constipation. Paralysis and death can follow between 18 and 36 hours later if untreated.

Cryptosporidium parvum

Members of this family are parasites from the intestinal tracts of fish, reptiles, birds and mammals. Clostridium perfringens

This is distributed throughout the environment and is normally found in human and animal intestines. The illness is caused by bacteria releasing toxins in the digestive canal. Symptoms include intense abdominal cramps and diarrhoea, and usually lasts less than 24 hours. It can last up to two weeks in severe cases. The illness can be mistaken with 24-hour flu.

Food sources

Meat, meat products and gravy are usually implicated with food poisoning caused by clostridium perfringens. The young and the elderly are most at risk.

Clostridium botulinum

Clostridium botulinum causes severe food poisoning, and is caused by the ingestion of foods containing the neurotoxin formed from bacteria. The illness is rare but can be fatal and can be destroyed by heating at 80ºC for at least 10 minutes. Symptoms can show up 4 hours to 8 days after ingestion, and include weakness, vertigo, double vision, difficulty in speaking, swallowing and breathing, muscle weakness and constipation. Paralysis and death can follow between 18 and 36 hours later if untreated.

Cryptosporidium parvum

Members of this family are parasites from the intestinal tracts of fish, reptiles, birds and mammals. Cryptosporidium is passed in the faeces and is common in drinking water which originated from drainage of agricultural land. Symptoms usually include short term diarrhoea unless you suffer from a compromised immune system which can make the illness more severe.

Escherichia coli (E coli)

Normally found in animal and human intestines, E coli can be serious. One group of bacteria cause severe infantile diarrhoea and another cause traveller´s diarrhoea. Food sources include undercooked minced beef and unpasteurised milk. The elderly or very young can develop anaemia and renal failure. Symptoms include abdominal pain, fever, diarrhoea and vomiting and normally show between 10 and 72 hours after ingestion and last between 1 and 5 days.

Avoid E.coli

Ensure all meat is cooked thoroughly and juices run clear when spiked. Always avoid unpasteurised milk and separate raw and cooked foods to prevent cross contamination. Disinfect all surfaces and utensils used for food preparation. Wash hands regularly and always use a disinfectant hand wash.

Giardia lamblia

Giardia lamblia is a parasite which exists in two forms and lives in the small intestine, and is passed through faeces. Symptoms include severe diarrhoea from contaminated food or water.

Listeria monocytogenes

Listeria monocytogenes is a food-borne illness which is often transmitted to ready-to-eat foods, and is widely found in sewage and decaying vegetable matter. To avoid listeria always wash salads before use, never eat chilled products after the sell by date, and ensure your fridge is kept at the correct temperature. The onset of symptoms is normally 8 days to 3 months, and they include nausea, vomiting and diarrhoea. Meningitis and blood poisoning can occur in pregnant women. Antibiotic treatment is effective.

Salmonella

Salmonella is found in animals, including poultry and pigs and environmental sources include water, soil, insects, kitchen surfaces, animal faeces, raw meats and raw seafood. Symptoms include nausea, vomiting, abdominal cramps, diarrhoea, fever and headache and normally start 6 to 48 hours after infection.

Shigella

Shigella is found in the intestine of man and other animals, and is also known as bacillary dysentery. Symptoms include diarrhoea, fever, vomiting and abdominal pain and can start 12 hours to 2 days after infection. Foods incriminated include salads, raw vegetables, milk and dairy products, poultry and contaminated water.

Norwalk Virus

Norwalk Virus is an intestinal infection which occurs in outbreaks and is normally associated with shellfish. The virus is passed in the stool of infected persons and people get infected by swallowing stool-contaminated food or water. Other sources of infection include salads, eggs, ice and ready to eat foods. Norwalk is more common in adults and older children and symptoms normally appear within 10 days. Symptoms include nausea, vomiting, diarrhoea and stomach cramps.
Anyone can get Norwalk virus infection, but it may be more common in adults and older children. Illness normally lasts 24 to 60 hours.

Food poisoning can be fatal

Food poisoning in the UK is increasing. The number of cases of Salmonella has remained high in the past few years, and Campylobacter cases have doubled.

Better training of food handlers needs to take place, and better care must be taken to ensure food is kept at the proper temperatures. Cross contamination is also a big problem which needs to be addressed.

Bacillus cereus

This is a spore forming bacteria which is often found in rice from take-away restaurants. Symptoms of Bacillus cereus include diarrhoea and abdominal cramps between 6-15 hours after consumption of contaminated food. Nausea may occur and symptoms usually last 24 hours.

You can contract the disease from meat, milk, vegetables and fish, but outbreaks have normally been associated with rice, potato, pasta and cheese products. Sauces, puddings, soups, casseroles, pastries and salads can also be contaminated.

Campylobacter

Campylobacter is a group of spiral-shaped bacteria that can cause disease in humans and animals. Most human illness is caused by Campylobacter jejuni. Birds carry this illness without becoming ill themselves. Proper cooking, milk
pasteurising and chlorination of water will all kill bacteria. This is the most common cause of acute bacterial diarrhoea in the UK. Symptoms include diarrhoea, cramping, abdominal pain and fever within 2-5 days after exposure, and can include nausea and vomiting.

Raw or undercooked meat and poultry, offal, contaminated water or milk. Contamination is usually from excreta of birds, cattle and family pets. 40,000 cases are reported annually in the UK.
