How much can I claim for holiday illness?


The latest guidelines released by The Judicial Studies Board estimate the amount of compensation which can be paid for pain, suffering and loss of amenity for food poisoning. The up to date amounts are:

£25,250-£34,500 - Severe toxicosis, causing serious acute pain, vomiting, diarrhoea and fever, requiring hospital admission for some days or weeks and some continuing incontinence, haemorrhoids and irritable bowel syndrome, having a significant impact on ability to work and enjoyment of life.

£6,300-£12,600 - Serious  but short-lived food poisoning, diarrhoea and vomiting diminishing over two to four weeks with some remaining discomfort and disturbance of bowel function and impact on sex life and enjoyment of food over a few years. Any such symptoms having these consequences and lasting for longer, even indefinitely, are likely to merit an award between the top of this bracket and the bottom of the bracket above.

£2,600-£6,300 – Food poisoning causing significant discomfort, stomach cramps, alteration of bowel function and fatigue. Hospital admission for some days with symptoms lasting for a few weeks but complete recovery within a year or two.

£600-£2,600 – Varying degrees of disabling pain, cramps and diarrhoea continuing for some days or weeks.
