Funding your claim

How to fund your claim will depend on various factors, and we will discuss the funding options with you, and recommend the best course of action for you before your claim commences.
Claims in England and Wales
It is normal that claims which are brought in England and Wales, if your claim is successful, your opponent will pay both your compensation and most, if not all of your legal costs.
It is important to ensure, that in the event your claim is not successful, you have something in place to ensure your legal fees are paid.
Some of the options available to you include:
Legal Expenses Insurance (LEI)
You may already have LEI as part of an existing insurance policy, such as your motor or household insurance, or possibly credit card insurance. You would need to check through your insurances to see if you have this cover.
Conditional Fee Agreement (CFA)
CFA´s are more commonly known as ´No win, no fee´ agreements. When discussing the CFA with you, we would recommend you take out an insurance policy, which we can deal with on your behalf. We will provide the insurance company with full details of your claim, and in the unlikely event that your claim is unsuccessful, the insurance policy will cover your opponent´s costs, VAT, disbursements and usually your legal costs.
Privately funding your claim
If you decide to fund the claim yourself, and the claim is not successful, you will be responsible for all legal costs incurred. If court proceedings are started, and your case is unsuccessful, you will also be responsible for paying your opponent´s legal costs plus expenses.
