A. You can claim for an accident or illness (typically food poisoning) sustained in a hotel or cruise ship, or in a road accident (even if abroad) which was not your fault.

A. Yes if you have suffered a personal injury or illness in the last 3 years which was not your fault. The time limits for bringing a claim may vary depending on in which country you sustained your accident or illness.
Q. What is involved in making a personal injury claim?
A. A personal injury claim is typically made against the tour operator who organised your holiday accommodation or against the other party who caused your accident, often the other driver in a road accident. The claim will often be made against the other party`s insurers.
Your solicitor will obtain a medical report which will substantiate your illness/injury and this will form the basis of your claim. On top of this your solicitor will claim any out of pocket expenses such as loss of earnings and medical expenses.
Q. Do I need to use a solicitor?
A. The simple answer is yes you should! Although you are entitled to pursue a claim yourself, this is not advisable.The law relating to making a holiday claim is complicated and the other side`s insurers will be experienced in defending claims and have unlimited resources.
